Are you the beneficiary of a will and have no idea whether you are being treated fairly?

Has the executor adequately complied with all requirements for notifying you of probate court filings, sent you a copy of the will and equitably divided the estate assets?

Any beneficiary or interested party of a will has standing to challenge the legitimacy of a will or how the assets are being divided. The attorney for the estate actually represents only the executors, not the beneficiaries. Beneficiaries need to retain their own attorney. Frequently, because it is a difficult period of time emotionally because of the loss of a loved one, beneficiaries believe they must simply accept actions of an executor. You may need to seek counsel if:

  • You are a beneficiary and do not receive a copy of the will within 30 days of the date of death of your loved one
  • You think you may be the beneficiary of any life insurance, annuity or IRA account and you do not receive notification within 20 days of date of death
  • You are asked to sign anything that you don't completely understand
  • You feel you are being "bullied" by the executor or estate attorney
  • You are not informed about the status of the will and distribution of the assets on at least a monthly basis
